INTRODUCTION - ACCEPTANCE OF TERMS

The website "www.e-restaurants.it", hereinafter referred to as "Website", is managed by the Greek company named "e-restaurants services M.IKE" based in Patras, at 18 Charalampi Street, Postal Code 26225, VAT: 802172747, Tax Office of Patras. The website was established to provide reservation services and the presentation of collaborating or contracted foodservice businesses, i.e. restaurants and establishments of sanitary interest, with the parallel possibility for users to make reservations electronically or by phone, accompanied by special discount privileges via the issuance of digital coupons/points.

In the interest of transparency, full information, and the safety and reliability of transactions and the use of this Website, the process of providing these services, as well as the procurement and distribution of discounted products, is subject to and governed by the following terms and conditions. These terms constitute the full and unconditional consent and agreement of the user or any person visiting the Website with regard to their use and access to it.

Users and visitors of the Website are invited to read carefully and comply with these terms and conditions, as continued use and browsing of the Website, as well as the utilization of any information or material provided by it, implies their full, explicit, and unconditional acceptance and agreement with these terms and conditions.

USE OF WEBSITE BY MINORS

This Website is intended exclusively for adults, and therefore, it is not permitted for minors under the age of eighteen (18) to use it. By accepting these terms and conditions, the user or visitor confirms that they are over 18 years of age, or if under 18, they have obtained consent from their legal guardians to use the services of this Website and to provide any information or details that may be requested for the purpose of the provided service. In any case, if minors visit or use services of this Website on their own initiative without the above-mentioned consent, and these actions could be considered harmful or inappropriate for them, the administrators of the Website bear no responsibility.

This content and these distinctive features are prohibited from being used by any user or visitor for commercial purposes, copying, distribution, modification, reproduction, retransmission, display, alteration, or any other processing or management, either publicly or privately, without prior written permission from the Website management or another legitimate rights holder.

The services provided by this Website are available exclusively for personal use and not for commercial or other purposes. Consequently, any commercial acts or preparatory and accompanying actions that make use or process the elements or features that constitute the intellectual and commercial property of this Website are prohibited.

It is emphasized that this Website provides the user or visitor with a personal and non-transferable right to access its content, elements, and information, and the right to display, use, and obtain the services offered. However, this does not grant the possibility of transferring, assigning, or further using the aforementioned rights of intellectual and commercial property.

CONTENT OF SERVICES

This Website presents and promotes foodservice businesses (restaurants and/or other establishments of sanitary interest) that are affiliated/partnered with "e-restaurants.it", showcasing their services and photographic materials. It offers the ability to make free electronic or phone reservations at these businesses, benefiting from special offers or privileges through the provision of digital discount points for future use, which will be categorized as "Restaurant Points" and "e-restaurants.it eatCoins" according to these terms and conditions. It is emphasized that the Website does not replace these foodservice businesses and the services they provide.

In this way, this Website intervenes and mediates to offer users a simple, fast, and effective service for making reservations at the mentioned businesses/restaurants, while also providing benefits in the form of discount points, referred to as:

a) "eatCoins", which will provide special discounts/offers on the total reservation bill at the business/restaurant where the reservation is made, for future use. Each eatCoin point can be redeemed at a list of businesses, which can be found by the user on the page https://www.e- restaurants.it/account/eatcoins by pressing the corresponding redemption button. The list of restaurants provided to the user is not binding and can change at any time. "e-restaurants.it" reserves the right to reject a reservation if it cannot accommodate a specific booking without giving any reason to the user.

The process and terms for making reservations, obtaining "Restaurant Points eatCoins", and the subsequent provided special discounts vary between affiliated businesses. Each business/restaurant has its own page on this Website where its services are displayed and promoted, and it includes a special electronic form through which reservations are made, with specific terms for each one. Depending on the business, the type of reservation, the number of people, and provided that the business’s minimum consumption requirement per person is met, users will obtain corresponding "Restaurant Points eatCoins."

Each "eatCoin" point is subject to specific terms and conditions regarding its acquisition and redemption, which may vary between each affiliated business, and are determined and adjusted according to the characteristics of the chosen business. These specific terms and conditions, based on individual agreements between "e-restaurants.it" and each affiliated business, can change at any time and are clearly stated on the page of the business through which the reservation is made. To inform the user, the corresponding "Restaurant Points" at each business will be displayed before the confirmation and completion of the reservation, so the user is aware of the benefit being offered, based on the type and content of the reservation they intend to make.

The redemption will take place at a time and in a manner according to the special terms and conditions set by each selected affiliated business. The value of each "Restaurant Point" during redemption – the discount – will be equivalent to 1 euro (1 eatCoin = 1 €). This means that the full amount corresponding to the "eatCoins" will be deducted from the total reservation bill.

The "Restaurant Points" can be used and redeemed in future reservations based on the limits of 25/50/80/120, and 200 eatCoins. The redemption period is specifically determined for each affiliated business and is stated as Monday through Thursday. The validity of the "eatCoins" will be renewed with each subsequent reservation that generates eatCoins. Redemption reservations do NOT generate eatCoins! The validity of the eatCoins will remain without a prior reservation (renewal or membership package purchase) for a period of 3 months, or for a period as specified by "e-restaurants.it". After this period, the "Restaurant Points" will be reset unless the Website management determines there are reasons to extend the expiration date. If no reservation has been made by the user, and therefore the eatCoins have not been renewed, the Website management will notify the user one month before the expiration of their points via email or SMS if possible.

It is emphasized that in the event an affiliated restaurant discontinues its activity or terminates its partnership with "e-restaurants.it", the "eatCoins" corresponding to that specific restaurant, which users possess at the time of the occurrence of such events, will be reset, and the Website will have no liability. In such a case, to protect and safeguard the interests and ensure timely information for the users of "e-restaurants.it", the Website management will notify users who possess such "Restaurant Points eatCoins" one month before the termination of the partnership via email or SMS, if possible.

Users are advised to exercise particular diligence and read carefully the terms and conditions for the acquisition and redemption process of "Restaurant Points" followed by each participating business.

b) "eatCoins e-restaurants.it" rewards, which in future use will offer special discounts/offers at selected affiliated/partner businesses/restaurants on the "e-restaurants.it" website, as part of a customer loyalty program through which the user of the Website can collect these specific Coins, which will offer discounts at these participating restaurants, different from the discount benefits provided by the "Restaurant Points" as described above. The user can collect "eatCoins e-restaurants.it" through the following methods. The distribution of "eatCoins e-restaurants.it" will take place via reservations, evaluations, and other promotional actions, where there is specific marking and information.

  • "eatCoins e-restaurants.it" collected from reservations will be credited after seventy-two (72) hours from the scheduled reservation time.
  • "eatCoins e-restaurants.it" collected from evaluations will be credited after review and activation. The Website reserves the right not to activate these evaluations if deemed appropriate on a case-by-case basis.
  • In the case of a cancellation by the participating restaurant or by the Website, the points will not be credited.
  • The redemption amount for each reservation is defined by the limits of 25, 50, 80, 120, and 200 eatCoins, and is calculated separately for each user based on an algorithm and in connection with the average consumption of each restaurant.
  • In cases of no-show incidents, as described above, the Website, in order to limit such occurrences and safeguard its interests and/or those of the restaurants, reserves the right to remove part or all of the eatCoins e-restaurants.it from the user.
  • "eatCoins e-restaurants.it" can be used and redeemed in a future reservation exclusively and only at selected affiliated businesses/restaurants participating in the customer loyalty program, as clearly identified and listed by the Website. The participating businesses/restaurants in this program may change or rotate at any time, at the discretion of the Website or the participating businesses themselves. Users will be informed about this through appropriate means, such as posting on the Website.
  • If a user is marked as inactive, the "eatCoins e-restaurants.it" they hold until then will be reset. A user is considered inactive if no reservation has been made through the Website system with the user's visit to the restaurant for a period of more than six (6) months.
  •  Transfer of "eatCoins" between users of the Website or between accounts of the same user is not allowed.
  • The redemption of "eatCoins" cannot be combined with other offers from the respective restaurant or across all e-restaurants.it reservations.
  • The discount from "eatCoins" cannot be combined with discount coupons or offers from third parties.
  • In any case, the Website’s administration reserves the right to remove or reset any points if it is found that they were acquired through malicious or unlawful means.

RESERVATION PROCEDURE AND SPECIAL TERMS FOR DISCOUNT POINTS – DEFINITIONS AND TERMS

  • The Website "www.e-restaurants.it" provides the ability to make free online or telephone reservations at tables of affiliated or partner mass catering businesses (restaurants or other establishments of public health interest), which may be accompanied by special offers in the form of discount points (eatCoins) that can be redeemed in future reservations as outlined above.
  • The electronic or telephone reservation process will be carried out by the user through this Website, following the booking of one or more tables for at least two (2) people at any selected affiliated restaurant or establishment.
  • A user of this Website is any person who has registered on the "e- restaurants.it" Website by creating a personal account through which they can make reservations and generally use its services and features. By registering, the user automatically becomes a member of "e-restaurants.it" and is bound by these terms and conditions. Access and connection to this account will be strictly personal and will be made by entering a username and password in the appropriate fields.

Reservations can be made as follows:

a) Online – via this Website, by filling out a specially designed reservation form on the page maintained by each restaurant or establishment, where the user must provide the following mandatory details: the desired reservation date and time, the number of people for whom the reservation is intended, the name of the person who will be entitled to the reservation, as well as a contact phone number and an email address.

b) By phone – through the contact phones of the Website, after contacting a representative during the operation hours of the phone center, with whom the user will make the reservation by providing the above details, except for the email address, which is provided optionally.

  • Each reservation is valid for a specific date and time, and for a specified number of people, according to the details provided by the user in the completed reservation form on the restaurant's page. Based on this information, the affiliated/partner business reserves the number and/or size of the table(s) according to the needs of each reservation, ensuring the proper fulfillment of the services of each reservation. Each reservation will correspond to specific discount points (as outlined above) that will result in special offers depending on the case and the type of the reservation and the chosen business. It should be noted that in case fewer people show up than the number stated in the reservation, there will be a corresponding reduction in the points granted by the business.
  • The reservation beneficiary can either be the user themselves or another person designated by the user by providing their name during the reservation process.
  • The reservation is considered completed once the beneficiary of the reservation receives a confirmation message either via mobile phone (SMS) or via email at the earliest possible time.
  • Upon arrival at the restaurant on the specified date and time of the scheduled reservation, the beneficiary must provide their name to the restaurant’s responsible person, as well as inform them that the reservation was made through the "e-restaurants.it" reservation system in order to receive the services and offers specified in their reservation.  The user of the reservation has the right to cancel their reservation only after making a phone call to a representative of the Website during the phone center's operating hours. Cancellation of the reservation through this Website can only take place up to two (2) hours before the scheduled reservation time.
  • In cases where the reservation beneficiary does not show up at the restaurant on the specified date and up to fifteen (15) minutes after the scheduled reservation time, without having previously canceled it according to the terms mentioned above, a no-show incident occurs. Such incidents do not financially burden the user or the reservation beneficiary and are communicated to the user via an informative email. However, in order to protect and safeguard the participating/partner restaurants, the administration of "e-restaurants.it" reserves the right to impose penalties in the case of no-show incidents, such as removing discount points from the user’s account or even deleting the user’s account from the Website. The Website’s administration also reserves the right to take legal actions to trace and determine the user's IP address or take any other legal action to block users from its services and protect its rights, should systematic or malicious violations of these terms regarding no-shows be observed. Each affiliated restaurant- business may follow its own policy for managing no-show incidents, possibly with stricter terms than those mentioned here and, therefore, may impose penalties such as canceling or refusing a reservation from a specific user if they violate the established terms.
  • The user of the reservation has the ability to modify their reservation details up to two hours before the initially scheduled reservation time, either by calling "e-restaurants.it" or by contacting the business/restaurant where the reservation was made. The modification will only affect the reservation time or the number of people for whom it is intended. If the user wishes to change the reservation date, they must cancel the existing reservation, as outlined above, and make a new reservation for the new desired date. In any case, modifying the reservation does not affect the terms under which it is governed, as detailed above.
  • Reservations through the e-restaurants.it platform cannot be combined with any other offer or provision from the restaurant through third parties.

LIMITATION/DISCLAIMER OF LIABILITY

The Website bears no responsibility for any deficiencies or failures in the quality, characteristics, or nature of the services provided by the affiliated/partner businesses/restaurants, nor for any damage incurred by the user or visitor of the Website for this reason. The exclusive responsibility for the product, its properties, and in general the provision of catering services lies with the respective business/restaurant where the reservation was made, and these services fully pertain to that business. Furthermore, the Website is not responsible for damages or losses that may occur to the user and/or the beneficiary of the reservation during the provision or non-provision of the aforementioned services by the affiliated/partner businesses/restaurants.

The data and information provided through the Website's services, as part of the promotion of the partner businesses, are based solely on updates and information provided by the restaurants themselves. For this reason, each affiliated business has exclusive and special access to a dedicated page through which it is solely responsible for managing, updating, and renewing all the services and products it advertises and provides, specifying their specifications, characteristics, and any peculiarities. Also, each business has the ability to contact the Website’s management by phone to notify about any changes to its details. The presentation of each business is based on the information it provides to the Website. Therefore, each affiliated business/restaurant has full responsibility and care for the content of these pages and, consequently, for the continuous accuracy, correctness, and completeness of its services and products.

Therefore, during the provision of its services, the Website, despite the efforts and oversight it continuously demonstrates within its ethical responsibility, assumes no liability (civil, criminal, or otherwise) regarding the above, nor can it guarantee or assure them, nor regarding potential errors (typographical, matching, or depiction of products, or others) or any kind of misrepresentation or inaccuracies that may characterize the information or services or the way they are presented on the page of each collaborating business.

OBLIGATIONS AND RESPONSIBILITIES OF USERS

Users agree, accept, and acknowledge that they will use this Website in a lawful manner, in compliance with Greek and European law, relevant International Conventions, and always in accordance with good business practices. Specifically, users and visitors are not allowed to use the Website for unlawful, malicious, or illegal purposes. In particular, they explicitly agree that they will not use the Website in any way that could harm a minor, transmit false, misleading, obscene, threatening, or blackmailing content, or infringe on the rights or dignity of third parties. They will not use the Website to install or promote any unauthorized or unsolicited advertising or messages, or to perform any other act with malicious content without the express written consent of the Website management. In the event that illegal use or use contrary to the above-mentioned examples is identified or detected, the Website management has the right to delete the user or visitor who engages in these actions without warning, and it reserves all legal rights, particularly to seek compensation for any positive or consequential damages arising from these actions. Furthermore, each user is responsible for maintaining the confidentiality of their personal account to prevent malicious use by third parties.

OBLIGATIONS AND RESPONSIBILITIES OF USERS

Users of this Website have the right to submit reviews and ratings for the services provided, their experience, or their service through a specially designed comment or rating form for each affiliated/partner business, only on the condition that they have received the services through this Website and only if the content of these comments agrees and complies with the terms of use of the Website and the following conditions.

A user gains the right to personally review and comment after forty-eight (48) hours from the scheduled reservation time and only if they have appeared at the restaurant.

The management of "e-restaurants.it" reserves the right to publish/post the content of the reviews and comments at a time it deems appropriate, at its discretion.

The content of the review (comments or ratings) may either be posted/published on the Website or used in whole or in part on other electronic applications or social media platforms or promotional tools used or controlled by the Website’s management.

In no case can the Website be considered to accept, adopt, or endorse the personal comments, reviews, or opinions expressed through it, nor is it responsible for their content. The exclusive responsibility for the expressed reviews or comments rests with the user who posted them.

  • In any case, each user must comment with decency, respect, good faith, and in accordance with established business ethics and laws. If a violation of these terms is observed, the Website management may intervene to prevent the publication of such reports or comments by deleting them or not posting them to protect its users and the affiliated and partner businesses from potential fraudulent or malicious behaviors.
  • The Website management retains the right to reject, delete, or not publish any offensive, vulgar, inaccurate, or offensive comment or report. It will also act if the comments contain or imply malicious or defamatory content, references, or ill-intended motives.
  • The Website may delete or not accept, in whole or in part, comments or reviews that contain, for example, inappropriate, offensive, ironic, defamatory, obscene, threatening references, or otherwise violate the law, good morals, or third-party rights.
  • Comments and reviews should be written in Greek or English in lowercase letters. The use of capital letters or Latin characters (Greeklish) is not allowed, nor is the presence of numerous spelling or grammatical mistakes that make the content difficult to read.

  • Personal references to individuals or subjective assessments or suspicions about sanitary or tax-related matters are not allowed. In any case, if a violation of the above terms and conditions in the commenting, review, and rating policy by users is observed, the Website management may intervene at any time to delete or reject, in whole or in part, comments, reports, or reviews.

NEWSLETTER COMMUNICATIONS

The website, for the needs of the services provided and in order to effectively and accurately serve and facilitate its users, maintains a record of email addresses of its users/members to send messages (emails) directly related to the services provided. These include, for example, messages regarding account creation, confirmation/cancellation/modification of reservations, updates regarding discount points, as well as general informational messages about the services and offerings of "e-restaurants.it" (newsletters) and participation in surveys, polls, or questionnaires. It is emphasized that the option to receive newsletters is at the users' discretion, who have the option to choose whether or not to accept the service of sending such informational messages by using the unsubscribe link provided in each newsletter.

Such informational messages can also be sent following a new member registration on the website, after making an online reservation to confirm or update reservation details, or to promote special offers and service proposals from "e-restaurants.it".

Similarly, for the purposes of the services provided, the website maintains a record of phone numbers provided by users/members to send the above messages or any other useful information related to the services via SMS. These messages will directly relate to the needs of the services offered by "e- restaurants.it" as described above. If any user/member does not wish to receive informational messages (newsletters) via SMS or email, they may declare this during their registration on the website or by using the user management tool to deactivate the relevant options.

CHANGES TO TERMS OF USE / POLICY CHANGES

The website management unreservedly reserves the right to modify or change the terms and conditions of use and the website’s policies at any time, without prior notice, in order to improve, evolve, and modernize the services provided, according to its needs and business practices. Furthermore, if any provision of these terms is found to be contrary to the law, it will automatically become void, without affecting the validity or enforceability of the remaining terms. These terms and conditions represent the binding agreement between the "e- restaurants.it" website and its users or visitors, regarding their transaction and services. For any disputes arising from this agreement and these terms, the courts of Patras are designated as competent.
